3rd Aug 2009 - Xiah, Jaejoong & Micky Official Statement "WE'RE SO TIRED EMOTIONALLY & PHYSICALLY", who filed for an Exclusive Contract Validity Suspension & Provisional Disposition Request against SM Entertainment on 31st July..
The 3 members revealed..
#1. For the past 5 yrs, the agency has bn controllin everything & becus of everything dey hv gone thru, dey are so worn out mentally & physically
Xiah, Jaejoong & Micky debuted as DBSK in early mnths of 2004 & hv bn wif the order of SM, traveling bck & forth frm Korea, Japan & China. Dey hv bn completing their schedules sleeping only 3 -4 hrs every nite, every single day except for 1 week of the year. (OMG!! Im so worried wif their health..)
Becuz of tis, their health has bn affected greatly & the amount of stress & mental weariness dey received was huge. However, the more SM got DBSK involved in foreign activities, d more tiring & almost impossible d activities became. Dey finally began to feel like dey were no longer SM artistes who were strieving to reach their dreams bt mere tools for the agency to get money. Bt the 3 members stil wish to continue wif their activities as a singer according to their own visions.
#2. The exclusive contract tat was set for 13 years is in fact a "SLAVE CONTRACT"
Wen dey talk of d exclusive contract, dey refer to their contract tat last 13 years. However, wen dey add d years dey wil serve in military, d period wil extend at least 15 yrs which means tat dey wld hv to be celebrities under SM's rule for at least 10 more yrs b4 dey cld even consider retiring.
If dey were to cancel their contract b4 the 13 years were over, dey would hv to pay a fine tat was thrice d amnt of all the investments made & twice the amount of how much dey earned. As this amount wld add up to 10s of millions of $$ if dey were to cancel their contract. Dey had no other choice but to stay at SM under the same conditions dey are suffering becus of rite now.
#3. The members did nt receive as much as dey shld hv for their hard work
Juz becuz dey were tied to such contract, doesnt mean dey received fair treatmnt frm SM for their hard work. Dey received no money for d contract & wen the division of income is seen for their albums, their contract states tat each member cn receive 1000,000 won only if dey sell more den 500,000 copies of their album.(So all DBSK fans pls support dem by buying their albums. (Poor them..). If dey do nt reach 500,000 copies, dey do not receive a single $$ frm the income earned frm d album. [This clause was altered on 6 Feb 09] But even after alteration, the members only receive around 0.4 - 1% each frm the album sales. [What the...]
#4. Members hv tried numerous times to fix the contract, bt SM did nt listen to their pleas
The 3 members repeatedly ask for suspension of their exclusive contract so dey could follow their own visions of being a singer. Bt SM tried to move d spotlight 2wards the 3 member's cosmetic company, which has nothing to do wif tis trial.
So the 3 of them believed tat the least dey cld do was hv the 2 sides talk & reach a compromise tat both sides wld agree on & even offered to find a proper place to do so. Bt nt only SM ignore tis.. their past & current attitude made it almost impossible for there to b any talks wif SM. Dere was no hope for any talks to happen wif the agency & tat is why d 3 members decided to file this lawsuit.
#5. The investment in Cosmetic Company was sumthing dey did outside of their activities as a celebrity. It has nothing to do wif this lawsuit. The focus point is the unlawfulness of d exclusive contract.
SM revealed in their official statemnet tat the 3 members were filling this lawsuit becuz of problems tat arose becuz of the cosmetic company. However, the member's investment in d cosmetic company has nothing to do wif the lawsuit. SM is referrin to the Chinese branch of d company tat d 3 members invested in & tis was purely a personal investment tat has nothing to do wif their activities as celebrities. No one can say tat DBSk shld lose everythin dey hv worked so hard for until now juz becus of an investment of $1million in a cosmetic company tat is opening in China. (tat's ridiculous to even consider)
The core of wat the members see as a prblm is d unlawfulness of the exclusive contract. SM must stop trying to move the spotlight to the cosmetic company tat has nothing to do wif tis case.
#6. None of the members want to disband. All dey want is to escape frm the tirades of their contract.
Dey realized tat many fans feared tat a disbandmnt wld arise frm tis lawsuit. However, tis lawsuit shld never be linked to the possible disbandmnt of the grp. Only the 3 members r involved in tis process becuz of the difference in opinion of a method of approach btwn d members.
Bt dere are no strains watsoeva btwn the members & dey all wish to kip their promise to their fans & stay 2gather. If dey had even a small chance to fix the unlawful clauses in their contract & pursue their music careers in d way dey wanted, dey r willing to go thru wif these process wif only the firm belief tat all 5 of dem wld b able to stand on 1 stage 2gather infront of their fans even after tis ordeal.
#7. Dey take tis as a step to becum more mature
3 members are extremely sorry for frightenin d fans who care so much abt DBSk wif tis lawsuit bt dey believe tis is a step 2wards a bigger dream. Dey promise tat dey wil b able 2 cum out of tis situation as better people & a better grp if dey receive support frm their fans.-------------------------------------------------------------------------------------------------
SM stated on 1st Aug DBSK is a representative grp of nt only d members or SM, bt of Korea & Asia as a whole & dey must fulfill tat by continuing on wif their activities as a grp. It cld b seen clearly tat SM wld stop any notion of a disbandment.
Dey hv gone into findin a resolution for tis dispute wif Lee Soo Man who is returnin to Korea as soon as he heard d news. The key to fixing tis dispute is how much Lee Soo Man is willin to listen to the members & how much he is willin to concede to the member's demands.
He has bn noted to b very disappointed wif the fact tat many r seeing Micky, Jaejoong & Xiah's lawsuit against their agency as a means of breaking away frm d agency & disbanding.
Wen lawyer Lim Sang-Hyuk, who is representing DBSk in d lawsuit, releases their official statemnt on the 3rd, the exact details of the lawsuit. Bt as of now, d 3 members hv voiced their opinions tat dey truly want to stay 2gather as d 5 members of DBSK & hv neva tot of goin off as a grp of 3 as rumors hv implied.
Tis means tat if conflicts abt the cosmetic company & d exclusive contract r resolved thru a compromise, dere wil b no chance of d grp disbanding, even a small step wil suffice in tis.
The 3 members' willingness to participate in d SM Town Concert on d 16th & the numerous A-Nation performances shows tat dere are no conflicts btwn the members tat r big enuf to cause worries/doubts & hv significantly slowed dwn fears circulating abt a disbandmnt.
Efforsts of fans who wish to kip DBSK as it is cn be seen everyware. On Daum Agora, a petition tat was created to kip DBSK as it is has alrdy gained 13,000 signatures in 1 day. Dere r even talks of silent protests. However, some fans are sayin tat too much involvemnt frm d fans may infact hurt DBSK's lawsuit & hv warned other fans to jus wait & watch quietly
(pls people calm down & let us jus pray 4 dem). Dere is a growing concern tat too much attention on DBSK may continue to create rumors tat wil make d entire process more complicated den it shld b...Rumors said tat dere is a deep rift btwn Micky, Jaejoong & Xiah's side .....wif U-Know & Max's side and tat d dispute btwn the 3 members & their agency ever since last April has becum so irreperable tat dere is no hope for a solution.
However, these rumors are only rumors & will only created more misunderstandings btwn members & the agency & wil only becom a hindrance & nt a helper.."There's more news about them so do check out again....will post it tomorrow..

Yesterday was fun.. Met Baya onni also my sis tagged along coz she's bored. (Yea I understand. RP sucks.. but sorry to those who are in RP bt I cant stand wat my sis are going thru. Hell no Im going to RP! If i hv to go RP I prefer to commit suicide ahahah~ kidding. Bt anyway I wil say NO NO NO).
We went to SPCA @ Bartley to see cuttie cuttie cats.. mm..actually onni wants to adopt cats. The cats was so adorable and reminds me of my jae-cloud hahaa~ actually we as in me & onni decides hubbies' names. Since I use to like cloud (i think tat's the spelling) from Final Fantasy.. den jae's face like to fantasy-like. I heard people said tat wen dey saw him face-to-face, he was like anime..REALLY?!!! Chung-malyo?! ARGHH!!!!
Ok snap it out.... well, last last week if im nt wrong me & onni was in the train.. and onni was sitting at the priority seat..so i ask onni if she's pregnant & she's alrdy 3 months pregnant...haha
So it happen yesterday we disturbed Ain by going to her workplace to scared her hahaah~
Wen to Funan to surprise Ain & she was really really shocked haha~ Lucky the guy at the front is big enuf for onni to hide behind him at the counter ahhaa~
Omg! Tat was so fun! So we went lunch wif Ain @ PastaMania and spend our time sharing & joking. Ain!!! haha~ She said Onni pregnant later come out baby cat haha...coz we told her tat onni was gg to adop a kitten..
Hahaah~ cant imagine how Donghae wil react if he was to find out tat his baby is a kitten hahah~(inside joke). Well we took photos~ again me & Ain are the models but we add 1 more model bt she's a going-to-b-mother hahaha~ Photos wil b publish here i guess soon well if I'm nt lazy hehehe~
Sumthing upsets us four went me & baya onni saw sumthing on the newspaper while we were in the train.
"Top K-pop group 'MAY DISBAND' "!!! What is this? Why must it b dem???!!! They going to split up?!! NO WAy. I almost break down after reading them. SM is totally unfair. What's wif the termination of their contract?! Why Jae, why Micky, why Xiah??!!!
Let's just calm down and wait for any news about them. I hope they are nt breaking up. Please, Lee Soo Man do something... We dun want them to do solos... we want them as them..as TVXQ...as DBSK...as THSK...
